Terms and participation conditions

for education, training and consulting services provided by IAI Institute for AI GmbH

Version: October 2026

1. Provider and scope

These terms apply to education, training and related services provided by

IAI Institute for AI GmbH
Auf der Heide 1
3730 Eggenburg
Austria
Email: office@institute-for-ai.academy

referred to below as “Institute for AI”.

They apply in particular to open training and qualification programmes, Educational Stacking modules, online and in-person training, live online sessions, on-demand learning, Corporate Learning programmes and other education services expressly offered subject to these terms.

Individually agreed consulting, strategy or transformation projects, particularly AI Strategy Sprint & Transformation, may be subject to additional or different terms in the relevant proposal or contract. In the event of a conflict, individual written agreements take precedence over these terms.

Our offers are addressed exclusively to business customers acting in the course of their trade, business or independent professional activity when concluding the contract. Bookings for private purposes are not offered. Mandatory statutory provisions remain unaffected.

2. Offers and contract formation

The presentation of programmes, modules, training, dates and prices on the website is for information and does not constitute a binding contractual offer unless expressly stated otherwise.

A contract may be concluded through written order confirmation, acceptance of an individual proposal, a binding booking through a designated booking process or another express confirmation by Institute for AI.

For company bookings, the contracting party is generally the booking company, even if individual employees are named as participants.

Institute for AI may decline bookings for objective reasons, particularly where admission requirements are not met, capacity is exhausted or an offer is no longer being delivered.

3. Scope of services

The specific services are set out in the relevant service description, proposal, booking confirmation or agreed curriculum.

Depending on the programme, these may include in-person events, live online sessions, on-demand learning content, learning materials, exercises, workshops, learning-progress checks, access to a digital learning platform, practical assignments, feedback, assessment preparation and other services expressly specified for the programme.

Services not expressly listed are not automatically included in the contract.

Institute for AI may make objectively justified adjustments to content, sequence, trainers, dates or teaching formats, provided these do not materially compromise the overall character, learning objective or agreed quality of the service.

4. Training and certification

Institute for AI designs and delivers its training and learning programmes.

Where a pathway provides for external person certification, the specified external certification body conducts that certification independently.

Participation in Institute for AI training therefore does not create an automatic entitlement to an external certificate.

External certification may be subject to the certification body's own assessment regulations, admission requirements, fees, resit rules and other conditions.

Unless expressly included in the Institute for AI offer price, assessment or certification fees must be paid separately.

Institute for AI may prepare participants for external certification, but does not decide whether they pass or fail or whether an external person certificate is issued.

5. Participation requirements

Participants are responsible for meeting the professional, technical and organizational requirements stated in the relevant service description.

For pathways that build on previous learning, specified modules, qualifications or evidence of competence may be required.

Online offers require a suitable internet connection, hardware and software. If external applications or AI systems are required or recommended for particular learning content, this is indicated in the relevant programme.

6. Digital learning platform and access

Where included in the booking, participants receive personal access to the learning environment used by Institute for AI.

Access credentials are personal and must not be shared with third parties without express permission.

The scope and duration of access depend on the relevant offer.

Institute for AI may suspend access in cases of misuse, unauthorized sharing or serious contractual breaches after requesting that the breach be remedied, unless immediate suspension is necessary for security reasons.

Short technical interruptions, particularly for maintenance, security measures or external service disruptions, cannot be completely excluded. Institute for AI seeks to maintain reasonable availability of the systems it controls.

7. Prices and payment

The prices expressly agreed when the contract is concluded apply.

Displayed prices state whether applicable VAT is included or payable in addition. Prices and other mandatory price components are disclosed before the contract is concluded.

Invoices are payable within the period specified in the invoice or proposal.

Online bookings may be paid through an external payment service provider.

Instalments, staged payments or project-specific payment schedules may be agreed for longer company programmes or individually agreed services.

8. Cancellation and rebooking by participants

Cancellation and rebooking are subject to the terms agreed before the contract is concluded. Where no special terms have been agreed, the statutory rules apply. These terms do not establish general cancellation fees.

For an agreed cancellation or rebooking, please notify us by email. Statutory withdrawal rights and the permitted ways of exercising them remain unaffected.

A booked place may be transferred without charge to another suitable person from the same company by prior arrangement, provided no personal admission requirements prevent this for the relevant training.

Unused services do not automatically qualify for credit or reimbursement unless required by mandatory law, an individual agreement or rebooking confirmed by Institute for AI.

9. Business purpose of bookings

Bookings are intended exclusively for business or independent professional purposes. This also applies to individual bookings by business customers and employees nominated by a company.

The booking company or person acting in a business capacity must be correctly identified when booking. Consumer bookings are not offered.

10. Cancellation or changes by Institute for AI

Institute for AI may cancel, reschedule or move events to another suitable format for an important reason, particularly trainer illness or unavailability, insufficient participant numbers, technical failures, force majeure or other circumstances that materially impede or prevent proper delivery.

Where dates change materially, a replacement date will be offered where possible.

If a booked service definitively cannot be delivered, payments already made for the undelivered part will be refunded.

Any further mandatory statutory rights remain unaffected.

11. Trainers and faculty

Institute for AI works with internal and external experts, trainers and specialist collaborators.

Naming a trainer does not entitle participants to have every session delivered exclusively by that person unless a service tied to that individual has expressly been agreed.

A suitably qualified replacement may be appointed if a trainer is unavailable.

12. Learning materials, copyright and usage rights

Materials, videos, presentations, worksheets, texts, graphics, templates, prompts, concepts and other learning content supplied by Institute for AI or its trainers are protected by copyright or other rights unless expressly stated otherwise.

Participants receive a non-exclusive, non-transferable right to use this content for their own learning and, where the relevant offer permits, professional purposes.

Unless separately authorized, prohibited uses include making content publicly available, sharing it with unauthorized third parties, reproducing it for commercial training or creating commercial training offers by substantially incorporating the supplied materials.

The trainers' and third parties' own rights remain unaffected.

13. AI systems and external tools

Some training content may involve practical use of third-party AI systems, software services or platforms.

These services are operated by independent providers. Availability, functionality, prices, terms and technical characteristics may change and are partly outside Institute for AI's control.

Participants are responsible for not unlawfully entering confidential, personal or otherwise protected information into external systems.

Any tools required as part of training are identified in the relevant offer.

14. Conduct during events

Institute for AI expects respectful, professional and non-discriminatory conduct.

In cases of serious or repeated disruption, harassment, unlawful conduct or substantial interference with other participants, a person may be excluded after a prior warning. Particularly serious incidents may justify immediate exclusion.

Further rights remain unaffected.

15. Recording live events

Live online or in-person events are recorded only where recording is planned for the format and permitted under data protection law.

Participants are informed of planned recordings accordingly.

A right to a recording or subsequent access to a live session exists only where included in the booking.

Participants may make their own audio, image or video recordings only with prior permission.

16. Data protection

Personal data is processed in accordance with applicable data protection law.

Further information appears in the current Institute for AI privacy notice.

Additional privacy information may apply to processing by external certification bodies, payment providers, learning platforms or other independent service providers.

17. Liability

Institute for AI is liable in accordance with the statutory rules.

No liability is assumed for achieving a particular economic, professional or business outcome through participation in training.

In particular, learning content, examples and demonstrations do not constitute individual legal, tax, financial or other regulated professional advice unless such a service has expressly been agreed and is provided by appropriately authorized persons.

Mandatory statutory liability rules, particularly for personal injury, remain unaffected.

18. Force majeure

If events beyond Institute for AI's reasonable control temporarily prevent delivery, particularly official measures, natural events, substantial infrastructure or network failures or comparable cases of force majeure, performance may be suspended for the duration of the impediment or postponed to a reasonable replacement date.

The parties' statutory rights remain unaffected.

19. Changes to these terms

The version incorporated when the relevant contract is concluded generally applies to that contract.

Subsequent changes do not apply retrospectively to existing contracts unless expressly agreed or permitted by law.

20. Governing law and jurisdiction

Austrian law applies, excluding its conflict-of-laws rules, subject to mandatory statutory provisions.

For business contracts, the court with subject-matter jurisdiction at the registered office of IAI Institute for AI GmbH is agreed as the competent court, to the extent legally permissible.

21. Final provisions

If any provision is invalid or unenforceable, the consequences are determined by the statutory rules.

The remaining provisions remain effective to the extent legally permissible.

Individual agreements, proposals and service descriptions take precedence over these general terms where they expressly provide otherwise.
